Terms of Service

1. Agreement and operator

These Terms of Service (“Terms”) form an agreement between you and Xyberverse Nexus, the operator of Quiyo (“Quiyo,” “we,” “us,” or “our”). By creating an account, accessing Quiyo, purchasing a plan or credits, or otherwise using the service, you agree to these Terms and the policies linked from them. If you do not agree, do not use Quiyo.

2. What Quiyo provides

Quiyo provides software tools for generating, editing, organising, publishing, conducting, attempting, analysing, and exporting quizzes and assessments. Features may include AI-assisted generation, quiz administration, public or private sharing, CBT-style sessions, result review, rankings, collaboration, and document or data exports.

Quiyo is a general-purpose quiz productivity product. It may be used for entertainment, events, practice, training, professional knowledge, academic activities, and other lawful purposes. Quiyo is not a school, examination authority, tutoring service, certification body, or source of professional advice.

3. Quiyo is not a marketplace

All paid products offered through Quiyo are supplied directly by Quiyo. Users may optionally share quizzes publicly, but public quizzes are user-generated content made available free of charge.

• Users cannot list quizzes or services for sale.
• Users cannot set prices or charge participants through Quiyo.
• Quiyo does not collect payments on behalf of quiz authors.
• Quiz authors do not receive commissions, royalties, revenue shares, or payouts.
• A public quiz does not create a buyer-and-seller relationship between users.

4. Eligibility and accounts

You must be legally capable of agreeing to these Terms. If the law where you live requires parental, guardian, school, or organisational approval, you may use Quiyo only with that approval. You must provide accurate account information, protect your credentials, and promptly tell us if you suspect unauthorised access. You are responsible for activity carried out through your account unless prohibited by law.

5. Limited software licence

Subject to these Terms, Quiyo grants you a limited, personal or internal-business, non-exclusive, non-transferable, revocable right to access and use the service. You may not copy, resell, sublicense, lease, reverse engineer, bypass access controls, extract source code, or exploit Quiyo except where applicable law expressly permits it.

6. Your content and permissions

You retain ownership of quizzes, prompts, questions, files, comments, profile information, and other material you submit (“User Content”). You confirm that you have the rights and permissions necessary to upload, process, publish, and share it.

You grant Quiyo a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transform, transmit, display, and otherwise process User Content only as reasonably necessary to provide, secure, maintain, and improve the service; comply with your settings; enforce these Terms; and meet legal obligations. This permission ends when the content is deleted, except for reasonable backups, legal retention, or content already shared with others where removal is not technically immediate.

7. Public quizzes and community features

When you mark a quiz, profile, comment, reaction, or related activity as public, it may be visible to other users and may be copied, attempted, discussed, or shared according to the available product controls. Do not publish confidential, private, or sensitive personal information. We may moderate, restrict, unpublish, or remove public content that violates these Terms, creates legal or safety risk, or harms the service.

Public visibility does not authorise commercial resale by Quiyo or other users. No ownership is transferred merely because content is publicly accessible.

8. AI-assisted features

AI-generated output may be incomplete, inaccurate, outdated, biased, repetitive, or unsuitable for your intended purpose. You must review generated questions, answers, explanations, classifications, scoring rules, and exports before relying on or publishing them. Do not treat AI output as medical, legal, financial, safety-critical, or other professional advice.

You must not upload content to AI features unless you are authorised to process it. Avoid submitting secrets, confidential institutional material, protected health information, payment-card data, identity documents, or other highly sensitive data.

9. Assessments, results, and decisions

Quiyo provides tools, not guaranteed outcomes. Scores, rankings, analytics, AI explanations, anti-cheating controls, identity settings, and exports may contain errors or be affected by configuration, connectivity, participant conduct, or device limitations. You remain responsible for verifying results before using them for admissions, employment, discipline, certification, medical education decisions, or any other high-impact purpose.

10. Acceptable use

You may not use Quiyo to break the law, infringe rights, deceive or harass people, distribute malware, facilitate fraud, evade access controls, scrape the service without permission, overload infrastructure, impersonate others, manipulate results, publish unlawful or abusive content, or interfere with another user’s experience. You may not use automated means to create accounts or consume resources in a way that is excessive, unauthorised, or designed to avoid plan limits.

11. Plans, subscriptions, credits, and payments

Paid access may include subscriptions, one-time purchases, usage allowances, and AI-credit bundles. Prices, currencies, taxes, billing intervals, trial terms, included features, and renewal dates are displayed before purchase. Subscriptions renew automatically until cancelled unless checkout states otherwise.

AI credits are limited software-use units. They are not currency, stored value, property, or a financial instrument; they cannot be transferred between users, exchanged outside Quiyo, or redeemed for cash. Unless required by law, unused allowances or credits may expire or change as described at purchase or in the product.

Web purchases may be processed and sold by an authorised merchant-of-record provider such as Paddle. Mobile purchases may be processed by Apple or Google. The payment provider’s buyer terms, privacy notice, cancellation tools, and mandatory consumer protections also apply to the transaction.

12. Cancellation and refunds

You may cancel a subscription using the billing-management method provided with your purchase or through the relevant app store. Cancellation normally prevents the next renewal and leaves paid access active until the end of the current billing period. Refund eligibility is governed by our Refund Policy, the payment provider’s rules, and applicable consumer law.

13. Third-party services and links

Quiyo may rely on third-party services for authentication, cloud hosting, AI processing, analytics, payments, app distribution, file handling, communications, and embedded media. Their terms and privacy practices apply when you use those services. We are not responsible for third-party websites, services, or content that we do not control.

14. Quiyo intellectual property

Quiyo’s software, source code, interface, designs, brand, logos, documentation, original content, and underlying technology are owned by or licensed to Xyberverse Nexus and are protected by applicable intellectual-property laws. Except for the limited licence granted above, no rights are transferred to you.

15. Moderation, suspension, and termination

We may investigate suspected misuse and may restrict content, features, purchases, or accounts where reasonably necessary to enforce these Terms, prevent fraud or harm, respond to legal requests, protect users, or secure the service. We may terminate accounts for serious or repeated violations. Where appropriate and legally required, we will provide notice or an opportunity to appeal.

You may stop using Quiyo at any time. Account deletion does not automatically cancel a subscription purchased through a separate billing provider; cancel the subscription through the billing channel first.

16. Service changes and availability

We may add, modify, limit, suspend, or discontinue features, plan allowances, integrations, and supported platforms. We aim to provide a reliable service but do not guarantee uninterrupted, secure, or error-free operation. Maintenance, third-party outages, network conditions, device limitations, and events outside our reasonable control may affect availability.

17. Disclaimers

To the fullest extent permitted by law, Quiyo is provided “as is” and “as available.” We disclaim implied warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

18. Limitation of liability

To the fullest extent permitted by law, Xyberverse Nexus and its personnel will not be liable for indirect, incidental, special, punitive, exemplary, or consequential loss; loss of profits, opportunity, data, reputation, or anticipated savings; or decisions made from quiz results or AI output. Where liability cannot be excluded, our aggregate liability relating to the service will not exceed the amount you paid for Quiyo during the twelve months before the event giving rise to the claim, unless applicable law requires a greater remedy.

19. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without limiting any mandatory consumer protections that apply where you live. Before starting formal proceedings, please contact us so we can try to resolve the issue. Subject to mandatory local law, disputes relating to Quiyo may be brought before courts with jurisdiction in Nigeria.

20. Changes to these Terms

We may update these Terms to reflect product, legal, security, or business changes. We will update the date above and provide additional notice when required by law or when a change is material. Continued use after the effective date means you accept the revised Terms.
